SEC vs. QWEST - Former execs ask court to dismiss certain claims

Former Qwest executives are asking a court to dismiss certain
claims filed by federal regulators, partly because the
government is invoking state-secrets privileges that the former
executives say will hurt their defense.
The Securities and Exchange Commission has alleged the
defendants' actions allowed Denver-based Qwest Communications
International Inc. to improperly report revenue.
Attorneys for former Qwest finance chief Robert Wood ruff,
former president Afshin Mohebbi and former accountants James
Kozlowski and Frank Noyes filed the arguments Wednesday in
federal court in Denver.
The defendants say classified information on Qwest's government
contracts would help their defense.
Former Qwest chief executive Joe Nacchio also is a defendant.
